Terms of Service

These Terms of Service (the "Agreement") govern the use of the fire safety service management platform (the "Service") provided by FireTrack ("Yangın Takip", "we") at yangintakip.com. The Service is intended for businesses (B2B); by registering for or using the Service you accept this Agreement.
1. The Service
The Service is a multi-tenant cloud software (SaaS) that enables fire safety service companies to manage their customers (organizations), sites, equipment (assets), maintenance and survey records, quotes and stock.
2. Accounts and Users
- The person opening an account represents that they are authorized to act on behalf of the business they represent.
- You are responsible for keeping your credentials confidential and for all activity under your account.
- Tenant administrators are responsible for their invited users' compliance with this Agreement.
- You must notify us promptly of any suspected unauthorized access.
3. Subscription and Payment
- The Service is provided on a subscription basis according to the selected plan. Plan scopes and fees are stated on yangintakip.com or in the quote/contract executed with you.
- Fees are invoiced in advance unless otherwise agreed in writing. The Service may be suspended for overdue payments.
- Price changes are notified in advance and take effect at the end of the current subscription period.
4. Data Ownership
- All data you enter into the Service (customer, site, asset, maintenance records etc., "Customer Data") belongs to you.
- You grant us only the limited rights necessary to provide, maintain and improve the Service.
- Upon termination you may request an export of your Customer Data within a reasonable period; afterwards the data is deleted, subject to statutory retention obligations.
- Details on personal data processing are set out in the Privacy Policy and the KVKK Disclosure.
5. Acceptable Use
- You may not use the Service for unlawful purposes.
- Security testing, reverse engineering, unauthorized access attempts and attempts to access other tenants' data are prohibited.
- You may not send automated requests at a volume that disrupts the normal operation of the Service.
6. Service Levels and Changes
We use commercially reasonable efforts to provide the Service without interruption; however, outages may occur due to planned maintenance, updates or causes beyond our control. We may improve or change Service features; changes that materially reduce core functionality will be notified in advance.
7. Limitation of Liability
- The Service is provided "as is". It is a tool that helps document fire safety compliance; actually performing maintenance and inspection obligations and complying with applicable regulations remains the sole responsibility of the user business.
- Except where liability cannot be limited by law (intent, gross negligence), we are not liable for indirect damages, loss of profit or loss of data, and our aggregate liability is limited to the subscription fees paid to us in the 12 months preceding the event giving rise to the damage.
8. Termination
- You may cancel your subscription at any time, effective at the end of the current period.
- We may suspend the Service or terminate this Agreement in case of a material breach that is not cured within a reasonable period.
- Data export and deletion after termination are governed by Section 4.
9. Governing Law and Jurisdiction
This Agreement is governed by the laws of the Republic of Turkey; the courts and enforcement offices of Istanbul have jurisdiction over disputes.
