User Agreement

This agreement is concluded between us and the company that subscribes to the Yangın Takip (FireTrack) service. If you are only visiting the website, the Terms of Use apply instead.
1. Parties

Subscriber: the legal entity or individual who registers for the service and creates their own workspace (tenant). The person registering on behalf of the subscriber declares that they are authorised to enter into this agreement.
2. Subject and scope
The subject of this agreement is the provision, against a subscription fee, of software for tracking fire safety equipment inventory, maintenance, periodic inspections, stock, quotes and invoices. The software is offered as a service; no source code or copy is delivered to the subscriber.
3. Rights and obligations
3.1 The subscriber
- Account security: the subscriber is responsible for the confidentiality of usernames, passwords and two-factor credentials. Actions taken from the account are deemed the subscriber's.
- Authorised users: the subscriber sets the permissions of the users it invites and is responsible for their actions. Accounts may not be shared.
- Content responsibility: the accuracy and lawfulness of customer, site and personal data entered into the system is the subscriber's responsibility. For that data the subscriber is the data controller and is responsible for informing the individuals and obtaining consent where required.
- Lawful use: the service may not be used in a way that infringes third-party rights, disrupts operation, or places excessive load through automated tools.
3.2 The service provider
- Exercising due care to provide the service without unreasonable interruption. Planned maintenance is announced in advance; live status is available on the status page.
- Backing up data regularly and restricting access rights.
- Not accessing subscriber data except upon a support request or legal obligation, and recording such access in the audit trail.
Although backups are taken by the service provider, subscribers are advised to export their own records regularly.
4. Payment terms
- Trial: a 14-day free trial is offered on all plans; no card details are required for the trial.
- Subscription fee: charged in advance, monthly or annually, at the published price of the selected plan. Current prices are shown in the pricing section.
- Automatic renewal: the subscription renews automatically on the same terms at the end of each period. Notice before the end of the period is sufficient to stop renewal.
- Plan changes: upgrades take effect immediately and the difference is charged; downgrades take effect at the end of the current period.
- Late payment: the service may be suspended if the fee is not paid. Data is not deleted during suspension.
- Prices exclude VAT; taxes and duties are borne by the subscriber.
5. Confidentiality and personal data
Data entered by the subscriber is not used for any purpose other than providing the service and is never sold to third parties. Details are set out in the KVKK Disclosure, the Privacy Policy and the Data Retention and Erasure Policy.
6. Intellectual property
All rights in the software, interface, brand and documentation belong to the service provider. The subscriber receives a non-transferable, non-exclusive licence limited to the subscription period. Copying, reverse engineering, decompiling or letting third parties use the software is prohibited.
Data entered by the subscriber remains the subscriber's property; this agreement grants the service provider no ownership over it.
7. Limitation of liability
The service assists with tracking fire safety processes; the actual condition of equipment, performing regulation-compliant maintenance and field decisions remain the subscriber's responsibility. The service provider's liability is in any case limited to the subscription fees paid in the preceding 12 months. Indirect damages, loss of profit and claims arising from data loss are excluded. No liability arises in cases of force majeure.
8. Term and termination
- The agreement enters into force when registration is completed and remains valid while the subscription continues.
- Termination by the subscriber: possible at any time without cause. No refund is made for the remaining period.
- Termination by the service provider: on 14 days' notice in case of breach; immediately in case of unlawful use.
- Dormancy: accounts that do not convert to a paid subscription after the trial may be closed after 90 days, with prior notice by e-mail.
- Data access after termination: an export may be requested for 30 days following termination. After that, data is destroyed under the retention policy; invoice and accounting records continue to be kept for their statutory period.
9. Changes
Terms may change. Material changes are notified by e-mail at least 30 days in advance; the subscriber is free to terminate within that period. Continued use after the change constitutes acceptance.
10. Miscellaneous
This agreement is governed by Turkish law. The Istanbul (Bakırköy) Courts and Enforcement Offices have jurisdiction. Notices between the parties are sent to the registered e-mail addresses. The invalidity of one provision does not affect the others.
